Terms of Service

Azuretek Web Services agrees to provide you services as specified on the Order Form. You have been advised and understand that Azuretek Web Services service relies on and is limited by the inherent shared nature of the internet and that Azuretek Web Services will use its actual best efforts to provide you with the highest speed at which data will pass through networks controlled by third-parties reasonably available. Azuretek Web Services will provide all equipment and installation services up to and including your server, but will not be responsible for configuration beyond that.

Technical Support

At its discretion Azuretek Web Services may, but is not required to, assist you in configuring your equipment to utilize Azuretek Web Services service. Any assistance which Azuretek Web Services may provide is without warranty of any kind and in consideration for such assistance, you expressly waive any and all claims against Azuretek Web Services which may arise from such assistance. Azuretek Web Services supports and monitors its service 24 hours a day. The ticket system is to be used for all service requests.

Billing

Your account will be charged monthly on the day of the month in which service began. It is not our policy to offer retroactive refunds. In the event Azuretek Web Services does not receive payment, your service will be terminated after five days. All data stored with us will then be deleted after thirty days. You are entitled to terminate this service arrangement at any time via written notice.

Bandwidth

Azuretek Web Services will not charge overages and we do allow bursting. However, do not expect to abuse these policies. We expect a client's maximum usage to be under 10Mbps at the 95th percentile. We will warn you if you're using too much bandwidth, but repeated occurrences of this will result in the need for a cap, a commit, or a cancellation.

Use and Abuse of Service

You understand and agree that services provided to you by Azuretek Web Services may only be used for lawful purposes; that the you are fully responsible for any data or traffic originating from your customer IP connections; and to assist Azuretek Web Services in investigating all uses not permitted by this Agreement which Azuretek Web Services believes have originated from the your customer IP connections. Abuses include, but are not limited to (i) transmission of unsolicited bulk email ("SPAM"), (ii) transmissions from computers involved in Denial of Service attacks, IRC bots, "Hacking" activity and any other activity which is generally defined by the global internet community as malicious. Furthermore, if you are utilizing BGP to exchange routing information with Azuretek Web Service, you represent and warrant that you have the requisite authority to "route" any IP address space to which you are announcing on the internet. You also understand that while Azuretek Web Services makes an effort to properly filter announcements, you are responsible for all liability resulting from your actions including the incorrect or malicious announcement of a third party's IP address space. If your behaviour causes problems for our network or other customers, we will request that you cease your activities or risk termination of service.

Maintenance

Azuretek Web Services reserves the right to interrupt service for routine maintenance at such times as may be reasonably necessary. Azuretek Web Services will not be liable to you for any consequences of any interruptions to the service, which may render you unable to access the internet.

Force Majeure

You acknowledge that Azuretek Web Services ability to provide its services may be impeded by events or actions outside of Azuretek Web Services reasonable control, including, without limitation, acts of God, floods, fires, hurricanes, earthquakes, acts of war, labor actions, failure of third party suppliers, changes in applicable laws and regulations, or any similar action or event. You agree that In the event of a Force Majeure, Azuretek Web Services shall not be responsible for any failure to provide service and Azuretek Web Services agrees that in such an event you will not be liable for payment of the fees otherwise due under this Agreement.
